End-user license agreement

This License Agreement (hereinafter - the agreement, the license) is a legal agreement between you, the end user (the natural person, hereinafter - the "you", "you", "user") and Licensor - the developer of this software (product) (further - Developer) is an agreement for this software (hereinafter referred to as the product) which is included with your license agreement. You must to check the license agreements in the updates, supplements, and other product components.

1. Terms and definitions
1.1 Product – it is this software (this game, this application), and any digital media, audio-visual products, distributed with this software (product), for which the present agreement. Product, including all media, materials and electronic documentation, is copyrighted and protected by law. The product also includes any updates, additions, and other components that developers provide your use, provided that these components are not accompanied by a separate license agreement or terms of use.
1.2 Developer - author of this Product, the owner of all copyright in the Product.
1.3 User - any natural person using the product in accordance with this agreement.
1.4 Distributor - distributor of copies of this product.

2. Acceptance of this license
2.1 By installing, copying, downloading, accessing or using the Product in any other manner, you agree to the terms of this License Agreement (thus you give your acceptance). To use the product, you must accept the terms of this Agreement.
2.2 This product distributed without pay, for an unlimited period of time (a non-exclusive perpetual license).
2.3 This Agreement is valid till the moment of its cancellation.

3. Cancellation of the present agreement
3.1 You have the right to refuse the given agreement under condition of removal of the Product and all parts of Product from all your devices and data carriers.
3.2 This Agreement shall terminate automatically if it will be found that you do not satisfy a condition (or conditions) the present agreement.
3.3. After cancellation of the present agreement you have not the right: to store copies of the given Product and its parts on your devices and other data carriers, to use the given Product both its components and other materials falling under actions of the present Agreement.
3.4. Developer may, without explaining the reasons to remove the product, to revoke the license and stop the distribution and / or support services. The product can be removed at the initiative of the Distributor, in accordance with the agreement between the developer and distributor.
3.5 Cancellation of this Agreement does not entail withdrawal liability for breach of this Agreement by you.
3.6. This agreement may be changed unilaterally by the Developer. You, if this license agreement has change, must either accept the new agreement, or to refuse the new agreement. When making a new agreement, this agreement will expire. The new versions of the product may be provided with new agreement. You need to check for changes to this Agreement prior to and / or after and / or during the application update and / or immediately after the upgrade.

4. The rights and duties of the parties.
4.1 You have the right to use this Product in according to the present agreement. All actions that are not explicitly permitted by this agreement is forbidden.
4.2. You have the right to install this Product on the devices which belong only to you, and to do not access of the third parties to the given Product (except for the cases, stipulated item 4.4).
4.3. You have the right to use the Product only personally for the entertaining and game purposes.
4.4. Permission is granted to allow a single user (only natural person), without any benefit for you to the Product on your device exclusively for the playing with you, for no more than to finish the game, provided that this does not affect any right of the developer, and does not contradict the other items of this agreement. With a accessing of third parties are not allowed to copy the Product to other devices and storage media. You are required to monitor and control the actions of third parties. You are fully responsible for the acts or omissions of third parties. Third parties do not have to perform any act where not expressly authorized by this Agreement.
4.5 You do not have the right to distribute, transfer, sell, copy, delegate the right to the Product to the third parties.
4.6 You have not the right to give access to the third parties to the Product (except for item 4.4).
4.7 You may only use the Product for purposes not contrary to (a) this Agreement and (b) all applicable laws, regulations and generally accepted in the relevant jurisdiction, methods and recommendations (including any laws regarding the export of data or software to and from the United States, the Russian Federation and other countries, which are directly or indirectly related to this Agreement and the product).
4.8 You agree do not any actions that violate laws your country, the Russian Federation, the United States and other countries, which are directly or indirectly related to this product.
4.9 You agree to the greatest degree, resolved by the law, do not create, do not distribute, do not patent the software precisely copying this Product or similar on functionality with the given Product or using functions belonging only to the given product.
4.10 You not have the right to decompile the Product and its components, to study methods of functioning of this Product if it obviously is not authorized by the law.

5. Support of the Product.
5.1 To support this Product the Developer can release updates (new versions of this product). Updates can include other licenses that you have to yourself without any warning and reminder to read. You may install and update a product to replace this Product. The developer is not responsible for non-compliance product updates to your expectations.

6. Disclaimer of warranties
6.1 You expressly understand and agree that your use of the Product is at your sole risk and that the Product is provided "as is" and "as available" without warranty of any kind.
6.2 Your use of the Product and any material downloaded or otherwise obtained through the use of this Product is at your own risk and you are solely responsible for any damage to your computer system or other device or loss of data that results from such use.
6.3 Developer further expressly disclaims all warranties and conditions of any kind, whether express or implied, including, but not limited to the implied warranties and conditions of merchantability, fitness for a particular purpose and non-infringement.
6.4 You expressly understand and agree that Developer and Distributor (by agreement of the developer with the distributor) shall not be liable to you under any theory of liability for any direct, indirect, incidental, special consequential or exemplary damages that may be incurred by you, including any loss of data, whether or not Developer or Distributor (by agreement of the developer with the distributor) have been advised of or should have been aware of the possibility of any such losses arising.

7. Limitation of liability
7.1 You expressly understand and agree that Developer and Distributor (by agreement of the developer with the distributor) shall not be liable to you under any theory of liability for any direct, indirect, incidental, special consequential or exemplary damages that may be incurred by you, including any loss of data, whether or not Developer or Distributor (by agreement of the developer with the distributor) have been advised of or should have been aware of the possibility of any such losses arising.

8. General Legal Terms
8.1 This Agreement constitutes the whole legal agreement between you and Developer and governs your use of this Product, and completely replaces any prior agreements between you and Developer in relation to the Product.
8.2 You agree that if Developer does not exercise or enforce any legal right or remedy which is contained in this Agreement (or which Developer has the benefit of under any applicable law), this will not be taken to be a formal waiver of Developer rights and that those rights or remedies will still be available to Developer.
8.3 Invalidity of any position of the present Agreement, owing to the local legislation, does not attract invalidity of other positions of the present Agreement, other positions of the present agreement will remain valid and will have validity.
8.4 Product may be subject to United States, Russian Federation, and other countries export laws and regulations. You must comply with all domestic and international export laws and regulations that apply to your use this Product. These laws include restrictions on destinations, users and end use.
8.5 You are obliged to be convinced, that the patent right and the legislation of your country, the country of your stay and the country of purchase of the Product allows to use to you the Product.
8.6 You cannot transfer or concede the rights given by the present Agreement. You cannot delegate the responsibility or the obligations imposed by the present Agreement.
8.7 This Agreement, and your relationship with Developer under this Agreement, shall be governed by the laws of the Russian Federation. You and Developer agree to submit to the exclusive jurisdiction of the courts located within the country Russian Federation to resolve any legal matter arising from this Agreement. Notwithstanding this, you agree that Developer shall still be allowed to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction.
